Copyright

Copyright is a statutory right granted by the State to the owner of an original creative work, including literary, dramatic, musical, and artistic works, as well as cinematograph films and sound recordings. Copyright protection comes into existence automatically upon creation of the work and does not require mandatory registration.

However, obtaining a copyright registration certificate significantly strengthens the enforcement of rights, as it serves as prima facie evidence of ownership before courts and enforcement authorities.

In India, copyright law is governed by the Copyright Act, 1957 and the Copyright Rules, 2013.

FILING AND PROSECUTION

ARKM IP Law Firm represents clients in the filing, prosecution, and registration of copyright applications across all categories of works. Our services are aimed at ensuring a smooth and efficient registration process with minimal procedural hurdles.

We assist our clients with:

  • Drafting and filing copyright applications

  • Classification of creative works

  • Responding to examination reports and objections

  • Attending hearings before the Copyright Office

  • Securing registration certificates in a timely manner

COPYRIGHT ENFORCEMENT

A registered copyright grants both economic (commercial) and moral rights to the copyright owner. While the law provides robust protection, it is the responsibility of the copyright holder to monitor and prevent unauthorized use of their work.

Unfair trade practices may include:

  • Sale and distribution of pirated copies

  • Unauthorized reproduction or adaptation

  • Commercial exploitation without consent

  • Digital and online infringement

At ARKM IP Law Firm, we ensure effective enforcement of our clients’ copyrights through:

  • Legal notices and cease-and-desist actions

  • Pre-litigation enforcement strategies

  • Negotiation and settlement measures

  • Civil and criminal enforcement actions

Where pre-litigation remedies are insufficient, we actively pursue injunctions and other reliefs from competent courts.

LITIGATION

ARKM IP Law Firm has a team of experienced and dynamic IP litigators with comprehensive expertise in copyright law. We represent clients before:

  • District Courts

  • High Courts

  • The Supreme Court of India

  • Various tribunals and statutory authorities

Our litigation practice focuses on protecting our clients’ creative, commercial, and moral interests through strategic, timely, and result-oriented legal representation.
